Over the past decade, more than 16,000 people have died in borewell accidents across the country. Madhya Pradesh has also faced such incidents. To address these accidents, the Madhya Pradesh government has introduced a new law called the Prevention and Safety Act-2024.
New Regulations
The law is now active throughout the state. Under this act, if proper safety measures are not taken by the drilling agency during the drilling of a borewell (well), both the agency and the landowner will face punitive action in case of an accident.
Penalties for Negligence
If an accident occurs during or after borewell drilling, an FIR will be registered against the drilling agency and the landowner. If they fail to follow safety guidelines, they may face a fine of up to ₹10,000 for the first offense and up to ₹25,000 for each subsequent offense.
In case of an accident or death, those found guilty will be punished under sections 100, 105, 106, and 110 of the Indian Penal Code 2023. Any expenses incurred for rescuing someone during an accident will be recovered from the drilling agency or landowner.
Closure of Borewells
Borewells must be closed within 90 days under this act. If an appeal is to be made against any order under this law, it must be done within 30 days. Drilling agencies must apply for permission on a designated web portal before starting drilling and provide complete information about the site and landowner.
Rewards for Reporting
Safety measures must be ensured during and after drilling. Inactive borewells must be closed by the landowner within three months. If the landowner or drilling agency does not cap the borewell as directed, they will be fined. This fine will be rewarded to the person who reported the issue. Authorities will take action based on reports or complaints about open borewells, and the complainant will receive a reward if the complaint is found to be valid.
